While the victim/complainant in a domestic violence case does not control the proceedings, their input is highly relevant. The most helpful thing a victim can do is create what is often referred to as an affidavit of non-prosecution that can be presented to the Crown Attorney and the Judge. Such affidavits can help the accused:

  3. Avoid strict punishments such as having to go to jail
Creating an Affidavit is the #1 thing a victim or complainant can do to help their spouse or partner who is charged with domestic violence.

While an affidavit does not solely determine what will happen with the case, it is the most substantial thing the victim can do to help. In addition to being legally beneficial to the accused, creating an affidavit shows that you care and are trying to do everything possible to fix the situation.

Most victims have no idea that calling 911/the Police will have such a substantially negative impact on their lives, relationship, and family until it is too late. Often the incident itself caused virtually no harm or injuries whatsoever and the complainant was under the false impression that the Police would attend at the residence to mediate the dispute.

Your affidavit can legally benefit your spouse/partner and show them that you have empathy and are trying to do everything you can to help.

Those accused of domestic violence crimes (assault, utter threats, mischief, etc) are often displaced from their home and family and are always facing the prospect of having to go to jail and get a criminal record which may render them unemployable, cause problems with their immigration status with IRCC, and ability to travel to the US and other countries in the future.
