Toronto Assault Charges Lawyer

Assault charges and Immigration (IRCC) Problems in Canada

Both domestic and non-domestic charges of assault can lead to immigration denials and deportation

Anyone who is not a Canadian Citizen can be deported and have their future immigration applications refused by IRCC because they were charged with assault, uttering threats, mischief, or any other domestic or non-domestic criminal offence.

When someone is charged with a domestic crime such as assault their lawyer will always immediately ask what their immigration status is because the result of the case can dramatically impact their future. Some individuals charged with domestic crimes will find themselves deported upon conviction. Others will have their applications for a tourist, student, work permit, and PR denied or delayed. Any assault, including domestic assaults, can also cause Canadian citizenship applications to be denied.

Getting the best possible outcome for the case is the most effective way to avoid problems with IRCC / immigration status.

The job of your lawyer is to do everything possible to ensure your criminal charges do not cause the IRCC to reject your application or deport you.

No matter what the circumstances the accused is always better off to avoid problems to begin with than try to fix them later. When it comes to immigration law in Canada and criminal charges the best solution is to get the charges dropped and be in a position to provide the necessary paperwork to IRCC so that they do not refuse your applications.

Once IRCC immigration decisions are made in your case it is very difficult or sometimes impossible to have them reversed.

We often get calls from people who have problems with their immigration applications / IRCC because they were criminally charged. In some circumstances it is because the case disposition is causing them problems. Other times it is their failure to submit certain specific paperwork in time or that they answered questions incorrectly on their visa application. Many of these problems could have been avoided completely had they received legal representation and advice from a qualified lawyer from the beginning (when they were first charged with the crime).

If you are charged with a criminal offence such as assault (Section 266) you should speak to a criminal lawyer immediately because getting the best result possible in your case is the most important step you can take to avoid problems with IRCC. In addition to potential Canadian immigration problems, being charged with assault can also cause you to be jailed and receive a criminal record that will also prevent you from travelling to or working in other countries such as the United States in the future.

We have dealt with over 2000 clients, many who come from places such as India, China, and throughout South America and Europe. Despite being charged with all forms of assault, uttering threats, mischief, criminal harassment, etc. (including domestic and non-domestic) as far as we know not one has been deported or had their IRCC immigration application denied.

The 3 most important components to avoiding problems with IRCC when charged criminally are:
  1. Getting the best result in their case possible (charges dropped)

  2. Ensuring they have the all the proper court paperwork to submit to IRCC, and

  3. Responding correctly on their immigration applications.
Protecting our clients immigration status is one of the top priorities of our lawyers when dealing with non Canadian citizens. We know the exact steps to take to maximize your chances of having no immigration problems. If you have been criminally charged, it is important to contact a lawyer right away to begin working on your case. The longer you wait, the greater the chances are that you will experience problems with IRCC in the future.
